TERMS OF SALE I)
Conclusion and termination of the sales contract These Terms and Conditions, as well as the individual sales conditions indicated with the information on certain products, represent the offer of HUBTRAC-ADRIA d.o.o. for the conclusion of the Agreement, and the user as a customer, by registering, placing an order or in any other way determined by these Terms and Conditions, accepts them, which is considered to be the conclusion of the Agreement between the user and HUBTRAC-ADRIA d.o.o., according to the conditions of sale specified in these Terms. The subject and commercial purpose of the Agreement is the purchase of a selected product or service via Hubtrac.eu with payment of the appropriate fee – the price of that product and/or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: printed promotional messages with purchase order, telephone with and without human mediation, and the Internet. The contract comes into force and is binding from the moment the user accepts the HUBTRAC-ADRIA d.o.o. offer. in one of the following ways: – by selecting payment and completing the order as a registered or unregistered user of Hubtrac.eu, – by selecting payment and completing the order via the 01 209 6375 telephone line or via e-mail received at email@example.com.) During the registration process or when creating a user account, the user is obliged to choose a name or names under which he will provide services and choose a security password and submit a valid e-mail address. All data required for registration or creation of a user account must be true, and the use or use of other people’s data is expressly prohibited. b) During registration, if you want to register through a Facebook account and want to comment and actively participate on our Facebook profile, Hubtrac.eu can use your full name, i.e. your Facebook account. c) Registration or user account is created only for one person and it is not allowed to communicate information about registration or user account to third parties. The user is obliged to keep information about his security password and user account. The use of someone else’s registration or user account is not allowed. d) For violation of the provisions of the Terms and Conditions from this chapter, HUBTRAC-ADRIA d.o.o. reserves the right, at its discretion, to terminate the user’s registration or user account, without the obligation to compensate the user for any cost or damage. e) Registration (which includes payment for the product and/or service) is considered to have concluded a contract between HUBTRAC-ADRIA d.o.o. and the user as a customer. f) The Agreement enters into force upon the user’s registration, i.e. from the day the user accepts the offer to enter into such an Agreement.g) In connection with the conclusion of the Agreement, the user will receive: a confirmation of the concluded Agreement, i.e. a pre-contractual notification from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014, 110/15), these Terms and the notification on the user’s right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement from Article 61, paragraphs 1 and 2 of the Consumer Protection Act. h) The User can unilaterally terminate the Agreement within 14 (fourteen) days without giving a reason. The user does not have the right to unilaterally terminate the Agreement: – if the service has been fully fulfilled, and the fulfillment has begun with his express prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Agreement if the service is fully fulfilled, – if the subject of the Contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery, – if the subject of the Contract is goods that, due to their nature, are inseparably mixed with other things after delivery. In order for the user to exercise the right to unilaterally terminate the Agreement, he must notify HUBTRAC-ADRIA d.o.o. about your decision to unilaterally terminate the Agreement before the end of the term, by an unequivocal statement sent by post (to Hubtrac Adria d.o.o., Ulica Crvenog križa 20, 10000 Zagreb), or by e-mail to firstname.lastname@example.org, in which you will state your first and last name, address, telephone number or e-mail address, and can also use the specified written form for unilateral termination of the Agreement. Also, the User can electronically fill out and send the Form for Unilateral Termination of the Agreement at https://hubtrac.eu/wp-content/uploads/2023/03/OBRAZAC-ZA-JEDNOSTRANI-RASKID-UGOVORA.pdf in the case of HUBTRAC-ADRIA d.o.o. send confirmation of receipt of notice of unilateral termination of the Agreement by electronic mail without delay. The deadline for unilateral termination of the Agreement is 14 (fourteen) days from the day when the goods that are the subject of the Agreement were handed over to the user or a third person designated by the user, who is not the carrier, or, in the case of a service, from the conclusion of the Agreement. In the event that the conditions for unilateral termination of the Agreement are met, the funds received from him will be returned to him, not including delivery costs, without delay, and no later than within 14 (fourteen) days from the day when HUBTRAC-ADRIA d.o.o., or Hubtrac. eu receives the user’s decision to unilaterally terminate the Agreement. The refund will be made in such a way that the user does not bear any costs in relation to the refund. Refund HUBTRAC-ADRIA d.o.o. can perform only after the goods have been returned to him and examined in what condition they were returned, considering the fulfillment of the conditions of the right to unilateral termination of the Agreement. The user is obliged to hand over the goods or send them to the address HUBTRAC-ADRIA d.o.o., Ulica Crvenog križa 20, 10000 Zagreb, without undue delay, and in any case no later than within 14 (fourteen) days from the day when HUBTRAC-ADRIA d.o.o., i.e. Hubtrac .eu, submitted its decision on the unilateral termination of the Agreement. The user bears the direct costs of returning the goods. Shipments sent by cash on delivery will not be collected. Before terminating the Agreement, the User is requested to call 01 209 6375 or contact email@example.com in order to have the procedure for returning the goods explained to him. The user is responsible for any decrease in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods. In case of damage to the original packaging, the refund amount will be reduced by a percentage corresponding to the value of the goods. In that case, you will be notified. If, at the user’s request, the execution of the service began during the term for unilateral termination of the Agreement, the user is obliged to pay HUBTRAC-ADRIA d.o.o. an amount that is proportional to what was delivered by the time the user notified HUBTRAC-ADRIA d.o.o. on unilateral termination of the Agreement.
II) Purchase conditions and procedure
The main characteristics of the product, the method of use, prices, special offers and benefits, payment and delivery methods refer to those that are valid at the time the order is placed. The above data will be indicated with each product. The price of the product and the delivery service, which includes the amount of VAT, are visible in the shopping cart before the order is placed. The cost of delivery may also be visible on some other parts of the page. All information about the purchase confirmation based on the electronic order will be delivered to the customer’s e-mail address specified in the registration/order process or in the shopping cart when entering data when concluding the order. All prices are expressed in euros. According to the legally determined exchange rate, 1 euro = HRK 7.53450. All prices include VAT. The same price of all items will be indicated on the invoice that will be delivered together with the goods. If the customer does not receive the order confirmation notification, there is a possibility that he entered his e-mail address incorrectly. III) Delivery and delivery conditions
a) the cost of delivery is calculated automatically when you purchase the product and you are issued an invoice with the price of the purchased products and the cost of delivery b) the cost of delivery within the territory of the Republic of Croatia is free for all orders regardless of weight, volume or address of the customer. Additional costs may arise in case of shipping abroad. c) the delivery deadline for products, which are stated to be in stock, throughout Croatia is 10 to 15 working days from the day the order is placed, in accordance with the intercity delivery deadlines of DPD and other delivery services d) the delivery deadline for products for places that are under a special delivery regime, the delivery period may be slightly longer by 3-5 working days, in accordance with the deadlines of the intercity DPD and other delivery services e) in the event of a change in the delivery period or any other important circumstances for the execution of the order, the customer will be notified notify our customer service immediately
IV) Claims and complaints
The ordered products are packed in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the packaging of the shipment when taking it over. By rejecting the receipt, the delivery service will fill out the Damage Record and return the shipment to HUBTRAC-ADRIA d.o.o., with a note that the shipment contains a defect. Complaints regarding the lack of products and all other complaints can be made in writing via electronic or regular mail: to the e-mail address: sales@hubtrac,eu, to the address: Hubtrac Adria d.o.o., Ulica Crvenog križa 20, 10000 Zagreb. In the event of a justified complaint, it is possible to terminate the contract with a refund of the amount paid or exchange for the same product or another product of the same equivalent value, i.e. with a surcharge or refund of part of the funds if necessary. If it is about damage and/or malfunction of the delivered goods, the buyer should send a photo of the said complaint to email@example.com so that it can be accepted based on subsequent physical evidence. HUBTRAC-ADRIA d.o.o. collects the advertised damaged, defective or wrongly delivered goods at its own expense if it is determined that the complaint is justified and that the buyer did not affect the defectiveness, damage or any lack of the goods. In the event of a justified complaint within the deadlines set by the Law on Obligatory Relations, the entire cost of replacing the product with a new one is borne by HUBTRAC-ADRIA d.o.o. /or service, in business practice it is customary to report the case to one of the competent institutions. Competent and official bodies then perform all the necessary checks to determine correctness and compliance with applicable laws. Upon making a decision, both parties, both the buyer and the seller, receive a specified record. Such an official record of an independent body is considered authoritative and sufficient to end the complaint procedure.
V) Method and procedure of payment
Payment of the product price and delivery costs can be made in one of the following ways: a) Payment via internet banking. The products for which the order has been concluded can be paid for via internet banking of any bank. After successfully executing the order, HUBTRAC-ADRIA d.o.o. forwards by e-mail all the necessary data for payment. c) Payment by general money order. The products for which the order has been concluded can be paid by payment via a general payment slip in all bank branches, FINA or Croatian Post offices. After successfully executing the order, HUBTRAC-ADRIA d.o.o. forwards by e-mail all the necessary data for payment. d) Payment by credit or debit card. The ordered products can be paid online with one of the credit cards: one-time American Express, MasterCard, Diners Visa or Maestro. Each of the mentioned payment methods may contain a fee prescribed by the conditions of the payment location. This fee is borne by the payer himself and is not recoverable from HUBTRAC-ADRIA d.o.o.

The exchange of sensitive data between the system that performs the online payment and the authorization centers of card houses is performed using a network that is completely protected against unauthorized access. DATA PROTECTION WHEN PURCHASING
HUBTRAC-ADRIA d.o.o. undertakes to respect the anonymity and privacy of users of the Hubtrac.eu online store and will use and process data exclusively for the purpose and purpose specified in these Terms. HUBTRAC-ADRIA d.o.o. can collect personal data of the user, such as name, address, OIB, telephone number or e-mail address only if the user voluntarily submits them to Hubtrrac.eu. HUBTRAC-ADRIA d.o.o. will automatically record data on the user’s usage habits of Hubtrac.eu, including a log file on visits to certain pages and/or content. Such data HUBTRAC-ADRIA d.o.o. will be used exclusively for the purpose of improving its service and adapting and individualizing promotional activities according to the needs of individual users. HUBTRAC-ADRIA d.o.o. nor can it guarantee that the service will be error-free. The pictures are informative and may deviate from the actual condition if the manufacturer changes the appearance, design, and/or packaging for some reason.
VII) Intellectual property
